Indianwave, whose website is published by Mr. Erwan Derrien, is an agency created by Mrs. Nitu Khosla, a self-employed entrepreneur in France who offers, via her website https://www.indianwave.fr (hereinafter "the Site"), advice and assistance in developing tailor-made trips to India.

These Terms and Conditions of Use (hereinafter referred to as "TOU") are intended to apply exclusively between Indianwave and any person wishing to access the Site and/or use the services offered from the Site (hereinafter referred to as "the User").

Any use of the services offered via the Site automatically entails the application of these T&Cs. We invite you to read them carefully.

We inform you that the provisions of these T&Cs are subject to change, in particular due to legislative and/or regulatory changes, without Indianwave's liability being sought. Changes will take effect upon posting on the Site (unless otherwise specified). The latest updated version will be available to all and permanently accessible on the Site, by clicking on the link Legal Notices and T&Cs at the bottom of the page of the Site.

Article 1: Legal information

1.1. The Site belongs to Mrs. Nitu Khosla, a self-entrepreneur, with a capital of 0€, registered with the Paris Trade and Companies Register under number 814203782000 10, located at 23 CHE DE L'ABREUVOIR, 78860 ST NOM LA BRETECHE and represented by Mrs. Nitu Khosla.

1.2. The site is hosted by OVH, 2 rue Kellermann - 59100 Roubaix - France. In accordance with the law, the author's personal identification details were provided to him.

1.3 Tailor-made travel design support services in India are developed by Ms. Nitu Khosla with her partners in India whose contact details are as follows:

Article 2: Definition

The Site: refers to the Indianwave website owned by Mrs. Nitu Khosla autoentrepreneur accessible from the address: https://www.indianwave.fr

User: any Internet user who navigates and/or uses the services offered by Indianwave from the Site.

Any Internet user who, after accessing the Site, (i) requests a quote, and/or (ii) accepts a proposal to assist in the design of customized trips to India and the associated services received from Indianwave.

Services: refers to all services offered by Indianwave, including support in the design of tailor-made trips to India and related services.

Article 3: Use of the Site

The Site is accessible free of charge in any place by any User with access to the Internet. All costs incurred by the User to access the Services remain at his expense. Similarly, Indianwave shall not be liable for any Internet connection problems caused by any equipment and/or operator used by the User (in particular, reduced speed or interrupted connection).

From the Site, Users have access to the following information and/or Services:
 

•     Informative content on the country of India, its culture, places and riches open to travel (free access to any Internet user)

•     Detailed information on the various tours and services offered by Indianwave (free access to any Internet user)

•     A specific access to request a quote online.

Article 4: Warranty and Liability

Indianwave will make its best efforts to provide access to the Site 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond the control of India at large and subject to any breakdowns and maintenance interventions necessary for the proper functioning of the Site.

Indeed, for the proper management of the Site, Indianwave may at any time:
 

• Suspend, interrupt or limit access to all or part of the Site, reserve access to the Site, or to certain parts of the Site,

• Delete any information that may disrupt its operation or contravene applicable regulations

• Suspend the Site in order to make updates.

Indianwave shall not be liable in the event of any failure, failure, difficulty or interruption in operation that prevents access to the Site or any of its features.

The equipment connecting to the Site remains the responsibility of the User, who must take all appropriate measures to protect his equipment and his own data, particularly in the event of viral attacks via the Internet. Indianwave may not be sought, the User remaining the only one to be held liable.

 

Article 5: General obligations of the Site User

The User undertakes to use the Site in accordance with the provisions of these T&Cs, public policy and morality, in compliance with intellectual property rights and image rights. Failure to comply with these provisions may result in Indianwave engaging the User's liability.

By using the Services, the User and the Customer represent and warrant that (a) all information provided is true and accurate; (b) they maintain the accuracy of such information; (c) their use of the Service does not violate any applicable law or regulation.

Article 6: Intellectual Property

All content and materials on the Service, such as text, graphics, videos, audio-visual works, logos, photographs, icons, images, audio clips and software, are the property of Indianwave or its licensors and are protected by the copyright laws in force in France and applicable international laws. The content and materials on the Site, operated, licensed or controlled by Indianwave may not be copied, except by a User solely for their personal use, and such content and materials may not be distributed, republished, uploaded, posted or transmitted in any way, without the prior written permission of Indianwave. Modification or use of the Content or Materials for any other purpose would violate the intellectual property rights of Indianwave and/or its licensors.

Indianwave, and other Indianwave trademarks and logos are registered trademarks and/or unregistered Indianwave logos (the "Indianwave Trademark"), are the property of Indianwave. Unauthorized use of these trademarks is prohibited by law. No part of the Service or the TOS shall be construed as granting, by implication or otherwise, any license or right to use any Trademark displayed on this Service without the prior written consent of Indianwave for each use. The use of any Trademark as part of a link to or from any website is prohibited without the prior written consent of India at large.

Article 8: Applicable law and competent court

These T&Cs are subject to French law. Any dispute relating to their interpretation and/or execution is a matter for the French courts.
